Actress Lindsay Lohan is back in court on her most serious charge to date. She's been charged with grand theft for allegedly stealing a $2,500 necklace. Lohan pleaded "Not Guilty" to the charge but the judge laid out a harsh reality for the troubled star.
"This case does involve jail time," said Judge Keith L. Schwart of the Los Angeles Superior Court, "If you plead in front of me, if this case is resolved in front of me, you are going to jail. Period."
This is the latest courthouse issue for Lohan who has been to jail twice and rehab twice in the last couple of years.
I am the type of person who hates seeing a star become a train wreck. I'm pulling for Lohan along with other struggling starlets. I want them to get their lives together and get back in the spotlight for their talents not their trials.
For the past few months, Lohan seemed to be doing just that. She was fresh out of rehab (though there is an assault incident being investigated from her rehab stint) and she looked to be on track for a comeback. Then, this necklace stuff started to go down.
Lohan had borrowed the necklace from a jeweler. Celebrities do it all the time. Stars will walk the red carpet wearing borrowed baubles; they are photographed wearing the jewels and both the jeweler and the star benefit from the good press. The star is typically required to give the piece back, but sometimes vendors will ship clothing and other accessories to stars as gifts for them to keep with the hopes that they will be photographed wearing their item, bringing buzz to that vendor's brand.
Lohan's camp has stated that this grand theft charge is really just a misunderstanding about whether the necklace was something Lohan was borrowing or something she was given. Lohan was under the impression that she would be able to keep the necklace if she was photographed wearing it in a major publication... which she was. When she heard that police were investigating her for stealing it and understood that it was, indeed, not given to her to keep, she pretty much went: "Oops, my bad, here's your necklace back. Sorry about that".
So the necklace has been returned to it's rightful owner. I don't see any criminal intent on Lohan's part. It's not like she broke into the store and stole the thing. Celebrities often have assistants handle the details in borrow/gifting situations like this and something may have been lost in translation. It looks to me like it was a simple misunderstanding.

I may be in the minority here, but I say: Cut the girl a break. If she's drinking and driving or doing drugs then send her to jail or rehab. But not for this. Give her a chance to get her life on track instead of throwing her back in jail for something I don't believe she intentionally did wrong.
