An Albemarle County man accused of making bombs is hoping a judge will dismiss the evidence investigators found in his apartment.

Jonathan Dean's attorney argued Wednesday that fire investigators improperly entered Dean's apartment back in November and the evidence found shouldn't be used. A neighbor at the Parks Edge Apartments testified to smelling gas coming from inside.

There, officials found bomb-making materials and a bomb in Dean's backpack. A judge will decide by next week whether to allow the evidence in Dean's trial on March 22.
