An Albemarle County judge decided on Tuesday to uphold a guilty conviction handed down from the jury in the Mark Weiner case .
In May 2013, a jury found 53-year-old Weiner guilty of abduction.
In April of this year, Weiner’s lawyers asked the judge to overturn the conviction saying the case against him was built on shaky evidence.
Weiner has maintained his innocence, but prosecutors say he tried to assault a 20-year-old woman who asked for a ride in December 2012.
Weiner's lawyers argued that the victim made up her story of abduction to get her boyfriend's attention. They say cell phone records from the victim's device show her far from the Shadwell home where she says Weiner assaulted her.
Weiner will be sentenced in July.
