The accident happened on Shiffletts Mill Road right after 1 a.m. Saturday. Police say James Frazier ran off the road, struck an embankment, and flipped, injuring himself and killing his 22-year-old son Christopher of Earlysville.

James Frazier, now at UVa Medical Center, was charged with driving under the influence and police say, pending the outcome of the investigation, he could face additional charges as a result of the DUI.

It's not known whether Christopher was thrown from the car, but he was pronounced dead at the scene.

"The passenger was not wearing his seat belt, he was the one that was pronounced dead. The driver apparently was wearing his seat belt, the vehicle was turned on it's side, it had not turned all the way over, it was on it's side." said Lt. Michael Hintz of Albemarle County PD.

This accident is the second fatal crash in two weeks for Albemarle County where the person was not wearing a seat belt. This was the scene last Tuesday when a Ruckersville man was killed when he lost control of his car and flipped.

James Frazier's injuries are said to be serious, but non-life threatening.
