Virginia Alcohol Laws Not Reviewed by Supreme Court

On Monday, the Supreme Court refused to review Virginia laws that limit the sale and consumption of out-of-state alcohol.

The state only allows Virginia wine to be sold at in-state-run liquor stores and restricts the amount of alcohol consumers can bring into the state for personal drinking.

The laws were upheld by a 4th U.S. Circuit Court of Appeals, reversing a lower court's decision that stated the act was unconstitutional because it impeded interstate commerce.

The appeals court noted that consumers had more than 10,000 privately run retailers to buy from that offer a variety of selection of wines.

Five consumers, wineries in Texas, California, Oregon, and a wine and beer retailer in D.C. brought the lawsuit challenging the ABC act. The Supreme Court has decided not to hear the case.
