A Spotsylvania judge has scheduled a hearing for the teen accused of killing and raping his sister and an attack of his toddler niece.
Police say that 16-year-old Walter Smith Jr. stabbed his 22-year-old sister Betsy Smith and beat her with a sledgehammer before raping her in the family's home on Monday.
Investigators say that when his two-and-a-half-year-old niece began crying, he fractured her skull with the sledgehammer, then locked the wounded girl and her one-year-old brother in a bedroom with his sister's body.
Smith is charged with the first degree murder of his sister and aggravated malicious wounding in the attack on the toddler. The judge set the teenager's preliminary hearing for November 27th and granted a defense motion for a blood test for the defendant, who's being held without bond.
