Albemarle County Police Officer Assaulted

November 11, 2010

An Albemarle County police officer was kicked in the face while arresting a Scottsville man for breaking and entering Wednesday night.

Police responded to reports of a break-in at the 3600 block of Richmond Road around 10:45pm Wednesday. Upon arrival, officers observed 34-year-old Rodger Payne sitting on the front porch. The break-in was reportedly domestic in nature and not connected to other break-ins that have occurred throughout the County.

After being taken into custody, police say Payne began to kick wildly, striking one of the officers on the jaw. Once he was put into the patrol car, Payne reportedly kicked out the right and left rear windows.

The officer suffered minor injuries and was treated and released from the hospital.

Payne is charged with breaking and entering with the intent to commit assault, assault and battery on a law enforcement officer and two counts of destruction of property.

Payne is currently being held at the Albemarle-Charlottesville Regional Jail while he waits for a bond hearing.
