UPDATE: Judge Waits To Decide In Harrington Lawsuit

Nearly five years have passed since Morgan Harrington disappeared during a Metallica concert at the John Paul Jones Arena in Charlottesville.

Harrington’s body would be discovered several months later on a remote section of a farm in Albemarle County.

Family members of Morgan Harrington appeared in a Charlottesville court Tuesday for a civil lawsuit against RMC Events.

RMC Events provides security at the John Paul Jones Arena, and it was their security guards that did not Morgan back into the venue after she stepped outside.

On Tuesday, a judge heard arguments in the case in order to decide whether the suit can go forward.

The Harringtons are arguing that Morgan suffered a head and chin injury while inside at the concert, and became disoriented. They believe Morgan left the venue while in a confused state, and that security staff had a responsibility to keep her safe.

RMC Events countered that they are a contractor and that they did not create the 'no re-entry' policy.
