Investigators say a Charlottesville Police officer was justified in firing shots at a suspect at the Elks Club last month.
Commonwealth's Attorney Dave Chapman says the police officer showed up at a violent situation where one man had just shot another.
The suspect Franklin Donnett Brown, has been indicted on charges of malicious wounding and making a threat with a gun. Police say Brown fired shots and wounded Leon Brock on March 16 at the Elks Club in downtown Charlottesville after the two men got in a fight inside the club.
When officer Alex Bruner showed up, investigators say he told Brown to drop the weapon, but Brown would not. So Bruner shot Brown twice, wounding him.
Bruner will not face any punishment from the police department because investigators say Brown was posing an "imminent risk" to Brock.
