UPDATE: The 37-year-old male driver has been charged with a DUI Friday night, after going off the side of Monacan Trail, just south of Charlottesville.

Albemarle County Police say blood has been drawn and sent to the labs.

All of this after the mini-van crashed in the 3900 block of Monacan Trail on Route 29 south.

A wrecked mini-van with kids' clothes and toys police found at the scene along with open containers of alcohol.

"The crash right now as we're investigating speed is not involved but alcohol is involved," said Sergeant Sean Hackney of Albemarle County Police.

"We have a 41-year-old female who has been transported in critical condition and a 37-year-old male who has transported in critical condition to UVa Medical Center."

The woman was sitting in the passenger's seat with no seatbelt on and was ejected from the vehicle. Police say initially there was information that a child was ejected as well.

"We were able to locate the car seat. And we are now confirming through family members that the child was actually dropped off prior to the crash so thankfully the child wasn't involved in the crash," said Hackney.

Police say it's important to contact them if you think someone on the road might be intoxicated.

"This vehicle was given out as a look out earlier as possibly being intoxicated so we're going to be following up on all of that. So, if you see something, say something."

Monacan Trail is a primary road for the rural area where police have seen several DUI crashes.

We do see a lot of fatalities and DUI crashes in years past we've had as many as four right here within this one mile area where we're at," Hackney said.
