Prosecutor Argues Against Dismissal of Chef Case

RICHMOND, Va. (AP) - A prosecutor says the Virginia attorney general's withdrawal from the embezzlement case against former governor's mansion chef Todd Schneider eliminated any conflicts, and the case should proceed to trial.

In papers filed Thursday, an assistant to Norfolk Commonwealth's Attorney Gregory Underwood urged a Richmond Circuit Court judge to deny Schneider's motion to dismiss a four-count indictment. Schneider is accused of stealing items from the mansion kitchen for use in his catering business.

Schneider claims the case should be tossed because Attorney General Ken Cuccinelli had political and personal reasons for seeking the indictments. Cuccinelli's office has withdrawn and has been replaced by Underwood. The prosecutor says there's no evidence of a vindictive prosecution.

A hearing on the motion to dismiss is set for July 8. Trial is set for October.
