Republican Mark Obenshain and Democrat Mark Herring’'s lawyers were in court this week hashing out the rules for the race.
A three judge panel overseeing the recount attorney general laid out the ground rules for the recount.
Its scheduled for on December 16,17, and 18.
Another interesting thing that came out of the hearing: there could potentially be a contested election.
That means those recount numbers have to come back quickly, because if one of the candidates wants to file for a contested election, that will happen on December 23.
A contested election is something the general assembly decides in Richmond.
That could mean a political body would be making a political decision in an election process.
And it some say that means Obenshain would have an advantage over Herring in the Republican Majority legislature.
