A federal court judge has ruled a lawsuit can move forward against the City of Charlottesville and the police department.
The city asked a judge to dismiss the lawsuit filed by Larry Monroe.
Monroe claims police violated his rights when they took a DNA test during the search for the serial rapist.
A federal judge says he will hear the case and lawyers will now push to have the case certified as a class action lawsuit.
Monroe filed a similar lawsuit last year in Charlottesville General District court and lost.
