Lake Monticello Rape Sentence

Ross Edward Stainback III , the man accused of raping an 11-year-old girl at Lake Monticello was in a Fluvanna County courtroom on Friday, awaiting his sentence.

The 25-year-old sat with his legs shackled and face down as he learned his fate. It was an emotional day for the Stainback family as Ross’ mother, father, and 10-year-old cousin took the stand, pleading to the judge for a light sentence.

“You can really see how young a ten year old is and in fact the victim in the case was an 11-year-old, so it was stunning they put her on the stand,” said Tom Boisvert, Lake Monticello Police Chief.

Stainback was sentenced to 24 years behind bars for the rape of a girl at Lake Monticello. The commonwealth attorney recommenced life in prison. Although he didn’t get life, Defense Attorney Jack Mous still thought the sentence was too harsh.

“I feel it was pretty severe under the circumstances. I understand Judge Brown’s concern that Mr. Stainback did not accept the responsibility for his behavior and certainly that’s the judges [discretion]. It's up to him to decide on the appropriate sentence. I just thought it was really severe under the circumstances.”

The Commonwealth Attorney painted a vivid picture of Stainback raping the child while he was babysitting her.

“He never [accepted] any responsibility for anything that he did. I appreciate the comments from the judge when he sort of called him out on that,” said the Chief.

Stainback all along blamed the child, saying she initiated the act. The judge replied by saying “I’m not the Easter bunny, and I don't believe in fairy tales.”

The judge pointed out the girl he raped was just one year older than Stainback’s cousin who took the stand this morning and that Stainback showed no remorse for the crime. The 11-year-old victim and her five siblings are currently in foster care.
