The scheduled arraignment has been postponed for a convicted rapist accused in a 1982 rape and murder in Culpeper that sent an innocent man to death row.
Kenneth Tinsley did not appear in court because officials said he was hospitalized on Monday with chest pains. The judge set a new hearing for December 12th.
Earl Washington Jr. wrongly confessed to the crime in 1985 and came within days of execution.
