Orange County Murder Case Moves Forward

The case against an Orange County man accused of first degree murder moves forward.

Charles Washington is accused of killing a woman with a scooter as she tried to stop him from fighting with another man.

Friday Washington was in court for a preliminary hearing. The judge decided to move the case forward. It now goes to a grand jury.

Defense Attorney Michael Hallahan says, " we were disappointed with the fact that we believe the Commonwealth failed to prove malice or premeditation and the matter was still certified but we understand that this is only a probable cause hearing."

This all stems from an incident on July 4th. Marylin Baker was sitting on her porch. She heard two men fighting across the street, and went over to break it up. While trying to disrupt the fight, witnesses told police she was hit by a child's scooter. She died from her injuries.

"This is a very unusual has a lot of issues in it that aren't normally in crime," Hallahan says.

The Commonwealth's Attorney says all the elements are there for first degree murder.

The prosecution is arguing transferred intent. They say whether or not baker was the intended target, the crime was willful and deliberate.

If convicted of first degree murder, Washington could serve life in prison.

The defense asked for bond based on Washington's record, but the court denied bail.

Washington is currently being held in the Central Virginia Regional Jail.
