Judge Lets Petition Against Dumler Stand

Albemarle County Board Supervisor Christopher Dumler was back in court Monday morning for a hearing on a petition to remove him from office.

Earl Smith had presented the court a petition with over 580 signatures from Dumler's Scottsville district to oust him from office back in March.

In court on Monday Dumler's defense argued the language in the statute to remove him is vague, but the judge disagreed.

The judge noted that Dumler's behavior is documented since he had pleaded to sexual battery, and the petition to remove Dumler from the Board should not be stripped.

Petitioners spoke about Dumler neglecting his constituents in the Scottsville district.

"If I'm a leader and I can't lead anymore then I should step down," says Smith. "That's been my premise this whole time."

Dumler's lawyer was also concerned because signatures were collected back in February, but Dumler's alleged neglect from his district did not occur until March.

Commonweath attorney from Lynchburg Mike Doucette says Dumler has failed to keep in touch with constituents by not holding town meetings and not being a voice on board committees when important issues are decided.

"What does common sense tell you someone's duties are when they are a member of the board of supervisors," says Doucette. "That's where the argument comes from."

Dumler will appear in court on May 20th to continue his hearing.
