Chris Dumler will be back in court next Tuesday to defend himself against an effort to remove him from the Albemarle County Board of Supervisors.
Lynchburg Commonwealth's Attorney Mike Doucette has been selected as the prosecutor in a hearing about a recall petition for Dumler.
For months, people have been calling for Dumler to resign in light of his sexual battery conviction in January, but he has ignored those calls.
So residents filed a petition earlier this week asking for Dumler to be recalled. They submitted 580 signatures, which is hundreds more than the number required by state law.
Doucette says recall cases are very rare. He can only find a handful of them in the past hundred years in Virginia. But the prosecutor is familiar with these kind of cases because he is currently working on another one for a public official in Sussex County.
Doucette says he plans to ask for more time on Tuesday to study the case against Dumler.
Dumler is currently serving jail time on weekends for his misdemeanor conviction. He maintains his spot on the board of supervisors and attends meetings during the week.
