Moseley Could be Facing Death Penalty in Fatal Stabbing

May 2, 2013

Christopher Moseley could be facing capital murder charges, and the death penalty, if it turns out that the victim, Alexis Rose, was pregnant.

"whether or not the victim in the case was pregnant at the time is a very significant factor and could make a difference as to how serious the charge ultimately is that will be brought against the defendant." says Charlottesville attorney Scott Goodman, who is not connected to the case.

Moseley is currently facing first degree murder charges after allegedly stabbing Rose to death in a grocery store parking lot on the night of April 30. He was arrested by State Police on Interstate 64 after he abandoned his own car in Goochland County, and the allegedly stole a pickup truck

It's very difficult to know what evidence they have against the defendant in this case, but one thing that is very incriminating circumstance, is that it appears the defendant was in flight away from the scene." adds Goodman.

"That's always something prosecutors and police use against individuals charged with a crime. Flight from the scene is certainly taken, in many circumstances, as indication or admission of guilt"

Moseley will appear in court on Friday, May 3 in the morning for his first hearing.
