Virginia Attorney General Ken Cuccinelli is declining to release records that document time, resources and meetings involved in his lawsuit challenging the Obama administration's health care reform package.
Ranking deputy Stephen McCullough said Wednesday that some of the records don't exist and others are confidential working papers. McCullough was responding to a request filed under the Virginia Freedom of Information Act by Democratic party officials and media outlets.
Virginia's open records law doesn't require Cuccinelli to create records that don't exist. Virginia Democrats have been critical of the lawsuit and charge that Cuccinelli is trying to block reform.
Cuccinelli says the lawsuit won't cost much more than the $350 federal court filing fee.
