Va. Mom Convicted of Neglect in Baby's Heroin Overdose

A Fairfax County jury has convicted a Springfield mother of child neglect in the heroin overdose of her 5-month-old baby.

Jurors also sentenced 36-year-old Marilyn R. Fischel to 30 days in jail on Wednesday, but she could spend only half that time in jail due to overcrowding.

The judge may impose or reduce the jury's sentence at sentencing on May 9, but cannot increase it.

Prosecutors accused Fischel of supplying heroin to two roommates who were babysitting her children in July. Fischl denied that she gave them heroin that day.

The babysitters snorted lines of heroin and one of them testified that the baby got a hold of the paper used to wrap the heroin and started chewing on it. Doctors said the boy - who recovered - suffered an overdose.
