Va. Mom Gets 30 Days in Jail for Baby's Heroin Overdose

May 10, 2010

A Farifax County judge has sentenced a Springfield mother convicted of child neglect in the heroin overdose of her 5-month-old baby to 30 days in jail.

A jury found 36-year-old Marilyn R. Fischl guilty of felony child neglect last month. They sentenced her to 30 days in jail and a judge imposed that on Friday.

Fischl did not express remorse or admit any guilt. But she said the drug treatment facility where he had been staying before her trial was a good place for her, instead of jail.

Prosecutors accused Fischl of supplying heroin to a roommate and friend who were babysitting her children in July. Fischl denied that she gave them heroin that day.

Fischl faces a trial on a heroin possession charge from an October search of her home.
