Virginia Marine Police say a 7-year-old boy was piloting a boat when it crashed, fatally injuring his mother.
Now police are asking the Hampton prosecutor to determine whether charges should be filed in connection with the deadly July 4 accident.
According to investigators, the boy was the controls of the boat on the Hampton river when it struck a pier and threw the woman into the windshield and then off the back of the boat.
Thirty-five-year-old Elizabeth J. Elliott of Hampton was pronounced dead at a local hospital.
John Bull of the Virginia Marine Resources Commission said Monday the state has no age restrictions to operate a motorboat.
He said an autopsy revealed Elliott died of severe head trauma.
