ISLE OF WIGHT, Va. (AP) - Prosecutors have dropped a legal effort to remove Isle of Wight County Supervisor Byron "Buzz" Bailey from office.

The Virginian-Pilot reports that the Suffolk Commonwealth's Attorney's Office dropped the case last week, citing lack of evidence. But prosecutors say it would be prudent for Bailey to resign.

Bailey declined to comment on the prosecution motion.

The case stems from emails that Bailey and Isle of Wight school board member Herbert DeGroft sent to others regarding first lady Michelle Obama. Critics say the emails were racially offensive.

Both men, who are white, have apologized for the emails.

The outcry led to removal petitions being filed in Isle of Wight Circuit Court against Bailey and DeGroft. The DeGroft petition is on hold because it didn't have enough valid signatures.
