Three Virginia Beach police officers involved in the fatal shooting of a robbery suspect won't face criminal charges.
Media outlets report that Commonwealth's Attorney Harvey Bryant determined the officers' use of deadly force was justified.
Bryant says in a recent letter to city officials that 33-year-old Daniel Guy Newcomb was wielding what appeared to be a rifle when the officers fired at him on March 17. Two officers fired 23 shots but missed. The third officer shot the Norfolk man in the chest.
Bryant says Newcomb's weapon was actually a toy gun. But he says there was no way the officers could have known that.
In 2009, Norfolk officers shot and wounded Newcomb after he wielded a starter pistol and threatened them. He wasn't charged in that incident.
