Va. Man Gets 5 Years in Baby Burning Case

December 9, 2010

A Madison Heights man has been sentenced to five years in prison for pouring scalding hot chocolate in an 8-month-old boy's mouth.

Twenty-two-year-old Robert Levalley denied responsibility before being sentenced Wednesday in Amherst Circuit Court on a malicious wounding charge. He entered an Alford plea in October, telling Judge Michael Gamble he didn't want to risk a jury verdict and sentencing.

Levalley blamed the child's injuries on the boy's mother, who is set to go on trial in January.
